Chaochao ("the Company", "Chaochao", "we" or "our") thanks all users for using the Chaochao website, application, and related services (the "Platform").
By registering, creating an account, posting a listing, purchasing or subscribing to a service, or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these terms and conditions ("Terms"), together with any other policies or terms the Company may publish on the Platform from time to time.
If you do not accept these Terms, please do not register, post listings, or use the Platform.
Chaochao is an online platform that acts as an intermediary presenting information and connecting property owners, brokers, real estate agents, or persons authorized to post listings ("Listers") with individuals seeking to search for and rent properties ("Searchers").
Chaochao's services may include:
Chaochao is not a landlord, tenant, broker, real estate agent, or party to any lease agreement formed between a Lister and a Searcher, unless the Company expressly states otherwise for a specific service.
Information about properties—price, images, location, amenities, number of rooms, availability status, and other listing details—is prepared and submitted to the Platform by the Lister.
The Company makes reasonable efforts to maintain the quality of information on the Platform but cannot guarantee that such information is accurate, complete, current, or free of error in every case.
To use certain services, you may need to create a user account.
You agree that you will:
You are responsible for activities that occur through your account, except where caused by the Company's fault or as otherwise required by law.
The Company has the right to suspend or restrict any account it reasonably believes is being used unlawfully, in violation of these Terms, or in a way that creates risk to users or the Platform.
Listers must have the legal right or authorization to list the relevant property.
Listers agree that the information in a listing must:
Listers must not create fake listings, duplicate listings intended to increase visibility, or use information that may mislead Searchers about the property.
If the Lister is a broker, agent, or other person listing on behalf of the property owner, the Lister represents that they have the authority or permission to do so.
The Company has the right to edit, hide, suspend, or remove any listing it considers to be unlawful, in violation of these Terms, or containing information that is inappropriate or misleading to users.
Searchers agree to verify important information before making any transaction decision, including but not limited to:
Searchers should exercise caution when making payments or providing personal information to Listers.
Chaochao cannot guarantee that every Lister is the property owner or an authorized representative, or that a Lister will honor any agreement made with a Searcher.
Contact, negotiation, entering into a lease, payment, security deposits, or any other transaction between a Lister and a Searcher is a relationship between those parties.
Chaochao is not a party to such transactions unless the Company expressly states otherwise.
Users are responsible for reviewing and considering relevant information before entering into any transaction.
The Company does not guarantee that:
If a dispute arises between a Lister and a Searcher, the parties should first attempt to resolve it between themselves. The Company may cooperate in verifying information or managing the listing as appropriate but has no obligation to become a party to the dispute or to bear liability on behalf of either party, except as required by law.
Some Chaochao services may carry fees or charges, and the Company will display the applicable price and terms before purchase or subscription.
Fees may vary depending on plan type, duration, features, or promotions set by the Company.
Users agree that they will:
Subscriptions or time-limited services are valid for the period specified in the plan selected by the user.
Upgrades, downgrades, cancellations, renewals, refunds, or plan changes are subject to the terms of the applicable plan and the policies the Company has published at that time.
The Company may refuse or cancel any transaction it has reasonable grounds to suspect is fraudulent, involves unauthorized use of payment information, or is otherwise unlawful.
Where the law requires the Company to issue a refund or bear responsibility for a payment, the Company will act in accordance with the applicable law.
Users agree that they will not:
The Company has the right to suspend, restrict, or remove any account or listing associated with such conduct, without prior notice, where the Company considers it necessary to prevent damage or risk to the Platform and its users.
Users retain ownership of the rights to content they lawfully own and submit to the Platform, such as images, videos, text, property descriptions, and listing data ("User Content").
Users represent that:
By uploading content to the Platform, the user grants the Company the right to use, reproduce, store, resize, convert, display, publish, and otherwise use such content to the extent necessary to provide, operate, improve, and promote the Platform.
This right is non-exclusive and does not transfer ownership of the User Content to the Company.
The Company may remove or suspend content it considers may violate these Terms, the law, or the rights of any other person.
The Chaochao name, logo, trademarks, website design, application, software, code, systems, databases, platform structure, and content created by the Company are the Company's intellectual property, or are used by the Company under license, and are protected under applicable law.
Unless authorized in writing by the Company, users have no right to:
with respect to the Company's intellectual property.
This provision does not extend to User Content, which the user owns or otherwise lawfully holds rights to.
The Company may review listings or user accounts for purposes of security, data quality, and compliance with these Terms.
A review or the display of any status, such as "verified", does not constitute a representation that the property, the Lister, or all information about the property is accurate or free of risk, unless the Company expressly states the scope of that review.
The Company may edit, hide, suspend, or remove a listing, and may restrict a user account, where it has reasonable grounds to believe the listing or account:
The Platform may connect to or use third-party services, such as map providers, payment providers, hosting providers, data storage systems, or other technology services.
Such services may be subject to the terms and policies of each respective provider.
The Company does not guarantee the availability, accuracy, or continuous operation of third-party services and may not be able to control disruptions caused by those providers.
The Company provides the Platform on an "as is" basis and to the extent reasonably appropriate at each point in time.
The Company does not guarantee that the Platform will:
The Company is not responsible for damage arising from the acts or omissions of other users, including information or conduct of Listers or Searchers, except to the extent the Company is liable under applicable law.
The Company will not be liable for indirect damages, special damages, loss of business opportunity, loss of profit, or any other damages arising from use of, or inability to use, the Platform, to the extent permitted by law.
Nothing in these Terms is intended to exclude or limit the Company's liability in any case where the law does not permit such exclusion or limitation.
To the extent permitted by law, if a user's act, breach of these Terms, or content submitted by the user to the Platform causes damage, a claim, or liability of the Company toward a third party, the user may be liable for the damage and expenses incurred by the Company as a direct result of that act.
This provision does not apply to damage arising from the Company's own act or negligence.
Users may terminate their own account through the method the Company provides.
The Company may suspend, restrict, or terminate a user's account or service if:
In urgent cases that may cause damage, the Company may suspend an account or content without prior notice.
Termination of an account does not automatically terminate obligations or terms that arose before the date of termination.
The Company places importance on protecting users' personal data.
The collection, use, disclosure, and processing of users' personal data will be conducted in accordance with Chaochao's Privacy Policy and applicable personal data protection law.
Users should read the Privacy Policy before using the service.
If a user encounters a listing, information, or content that may be false, unlawful, infringing, or fraudulent, the user may report it to the Company through the channel the Company provides.
The Company may review reported information and take action as appropriate, including hiding, editing, or removing the listing, or suspending the related account.
Submitting a report does not guarantee that the Company will remove such content in every case.
The Company reserves the right to change, modify, improve, add, or reduce the functions of the Platform, including suspending some or all services, for technical, business, security, or other appropriate reasons.
The Company may update these Terms from time to time.
Where a material change is made, the Company will notify users through an appropriate channel as reasonably practicable.
Continued use of the Platform after the revised Terms take effect constitutes acceptance of the revised Terms by the user. Where the law requires additional consent, the Company will act in accordance with the law.
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
If a dispute arises regarding use of the service, the Company and the user agree to attempt to resolve the dispute in good faith before pursuing legal proceedings.
These Terms do not affect any consumer rights or other rights users may have under applicable law.
If any provision of these Terms is void, unlawful, or unenforceable, the remaining provisions will continue to be effective to the extent permitted by law.
The Company's failure to exercise or enforce any provision of these Terms in one instance does not constitute a waiver of the right to enforce that provision later.
These Terms, together with any additional policies or conditions the Company publishes regarding the service, constitute the agreement between the user and the Company regarding use of the relevant Platform.
